Konečná

Radka Konečná graduated from the Faculty of Law, Charles University, Prague, and the Faculty of Economics, University of West Bohemia in Pilsen. She is a partner of Konečná & Zacha, Attorneys at Law, registered in the Register of Lawyers of the Czech Bar Association, Slovak Bar Association and is a member of ARTN (The Association for Real Estate Market Development). She speaks Czech, English, German, Slovak and Russian.

With her real estate team she represents a number of multinational corporations and foreign investment funds in their investments in the Czech Republic and Slovakia, particularly in the field of real estate and growth capital. Recently, she has dealt especially with development and subsequent sales or acquisitions of shopping centers with the value of approx. CZK billions (including forward sale thereof), preparation of investment structures in real estate, negotiating joint-venture agreements between significant players on the real estate market, development of logistic and residential complexes, including securing title insurance, project financing, construction projects also according to the FIDIC regulations and all aspects of leases and other steps associated with completion of the projects by sale. Her expertise includes, among others, also the issue of investments in various industrial sectors, including car-manufacturing and chemical industry.

Tomáš is a partner at Konečná & Zacha and specializes in financial law and regulation, complex commercial transactions, litigation, ICT and intellectual property law. In his areas of expertise, Tomáš often works with teams of Konečná & Zacha from Bratislava, Bucarest and Sofia on cross-border transactions and acquisitions. Tomáš speaks Czech and English and has a passive knowledge of Russian. 

Tomáš successfully advised on multiple gross-volume contracts concerning energy, construction, transport, mining, etc. He recently advised on several start-ups in area of finance, technology and e-commerce for local as well as foreign clients. Tomáš also represents Clients of Konečná & Zacha before Courts and in Arbitrations.

Achim Jähnke graduated from the Faculty of Law at Passau University, Germany and absolved supplementary studies at the Faculty of Law at Charles University in Prague. He is a partner of Konečná & Zacha, Attorneys at Law, and he is registered in the Register of Lawyers of the German Bar Association and in the Register of Lawyers of the Czech Bar Association. He speaks German, Czech, English, Spanish and French.

Achim is in charge of the German section of Konečná & Zacha, Attorneys at Law and with his team focuses especially on advising German speaking clients (DACH).

Since 1998 Achim has been working as an attorney both in Munich and Prague. Recently, he has dealt with mergers and acquisitions and real estate transactions including financing. He also provides comprehensive legal aid in all areas of law to medium-sized companies, which run their businesses on the Czech market.

Petko Iliev graduated from the Law Faculty of the Sofia University. A fully-admitted Bulgarian qualified lawyer, he has been leading on-site the Sofia practice of the firm since 2009. His experience started in the late ‘90s at the biggest Bulgarian law firm and was then diversified by an appreciable spell as Manager in the Tax and Legal Department of a Big 4 company.

Petko’s work has been largely focused on corporate governance (including public-listed companies in financial services and energy in the EU), contracts and M&A matters, the latter with particular emphasis on due diligence, structuring advice and acquisition support.

His knowledge and experience in corporate tax, VAT and, generally, tax litigation helps for a wider perspective of the matters he is handling. Those include foreign investment in Bulgaria for businesses in fast-moving consumer goods, real estate, pharmaceuticals and IT / media. He has recent contributions to the process of amending and EU-harmonization of domestic law on corporate agenda and capital markets.

Andrei Constantinescu

Andrei Constantinescu graduated from the Faculty of Law, „Titu Maiorescu” University of Bucharest. He also acquired a degree in Economics from the Financial and Accountancy Faculty, „Banatul” University of Timisoara. He speaks Romanian, English and Italian.

Andrei is a member of the Bucharest Bar and of the Romanian Union of Lawyers since 2003. During the first years of his career he has been involved in several EU-funded public administration reform projects, with special focus on drafting normative acts such as Laws, Government Ordinances and Government Decisions. Subsequently Andrei has gained experience in the M&A, corporate and real estate fields by assisting multinational companies such as a major multinational company for clinical studies or a top commercial centre developer.

In the last years, Andrei's relevant expertise includes advising a commercial retailer, a major Czech fashion online retailer and a well-known Taiwanese fitness equipment producer to establish presence on the Romanian market, providing extensive assistance on a large range of matters, from setting up corporate vehicles to negotiating and concluding commercial agreements. Andrei is also assisting a major international fuels distributor and an international wine producer/distributor with development projects and debt collection cases, including litigation.

While out of the office, Andrei enjoys extensive bicycle rides and playing tennis. He also plays the guitar and spends his free time learning to play new instruments.

Vitaliy Nosa is a graduate of Comenius University in Bratislava and is a fully licensed Attorney at Law in both Slovakia and Ukraine. As a Partner at Konečná & Zacha, Vitaliy is responsible for the firm’s operations in Slovakia.

In his practice Vitaliy focuses on cross-border transactions with an emphasis on acquisitions and market entry. Another area of expertise is elaborating tailor made models for international financing and profit repatriation. As a member of the Energy Team, Vitaliy advises private and institutional clients on all aspects of renewable energy sources development and operations. Vitaliy speaks English, Slovak and Ukrainian.

Adrian
Achimescu

Adrian Achimescu graduated from the Faculty of Law, University of Bucharest and acquired an LLM degree in Business Law and a University Diploma in Insurance Law from the Business Law Center, Faculty of Law in Montpellier, France, following a French Government Scholarship. He fluently speaks Romanian, French and English.

Adrian is a qualified lawyer in Bucharest, Romania and a member of the Bucharest Bar since 2007. During his career, Adrian has always worked in an international environment and has assisted many Romanian and foreign clients on various corporate transactions, mergers and acquisitions as well as the set-up of business presence in Romania. Also, he assisted on many financing projects by advising either corporate clients or banks in relation to financing agreements and security packages.

Adrian’s relevant expertise includes advising a large EU private equity fund in relation to the acquisition of a Romanian producer and distributor of drinking water; advising a major international bank with respect to the EUR 60 million financing of an infrastructure project in Romania and preparation of a complex security package; assistance and representation of a European company specialized in water infrastructure projects in an arbitration procedure in front of ICC against a Romanian public institution.

Adrian has significant expertise in Energy projects, especially Renewable Energy projects, and has provided legal advice and assistance to several international companies developing, financing, acquiring or administrating energy projects in Romania (Photovoltaic Power Plants, Hydro Power Plants, Wind Farms). Adrian also has good knowledge of Insurance law and European law.

Jakub
Čermák

Jakub Čermák graduated from the Faculty of Law, Charles University in Prague. He is registered in the Register of Lawyers of the Czech Bar Association and is an attorney-at-law cooperating with the Konečná & Zacha Prague-based office. He speaks Czech and English.

His specialization includes commercial and civil law, focusing in particular on the field of contract law and rental of business premises. He also participated in the provision of comprehensive legal services to major tenants of shopping centres and retail parks in both Czech Republic and Slovak Republic.

Tomáš
Fecák

Tomáš Fecák received master’s degree in law from the Masaryk University in Brno, and completed doctoral studies in international law at the Charles University in Prague. He also attended semestral study programs at the Ghent University (Belgium) and the University of Miami (USA). He speaks Czech, Slovak and English.

Tomáš has expertise in international investment law and in related aspects of EU law. Before practising as attorney, he worked for the Ministry of Finance of the Czech Republic, where he took part in negotiation of bilateral investment treaties. He is the author of the book titled “International Investment Agreements and EU Law”, which was published in Czech and English language versions, and is a member of the Czech Society of International Law.   

He is registered with the Czech Bar Association and is an attorney cooperating with the Prague-based office. His principal areas of practice include real estate acquisition projects and financing. He also advises clients on regulatory matters.

Ľuboš
Fojtík

Ľuboš Fojtík graduated from the Faculty of Law, Masaryk University in Brno. He is an attorney at law cooperating with the Prague-based office, where he leads the department of litigation and arbitration. In the field of litigation and arbitration, Ľuboš has gained significant experience in representing clients on both sides, i. e. claimants and defendants. Ľuboš has gained special experience in construction litigation while representing developers, institutional investors (including banks and investment funds) and municipalities in some of the most complex disputes in the Czech Republic.

Ľuboš further specializes in liability issues, damage compensation, contractual penalty, defamation and international private law including CISG a CMR litigation.

Ľuboš is also listed as an arbitrator with the Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic.

Besides dispute resolution Ľuboš has gained significant experience in providing legal services in the field of regulatory matters, especially in the area of data protection and public procurement, but also in several other regulated areas. He represents clients in administrative proceedings on a regular basis in front of public authorities as well as administrative courts.

Ľuboš is fluent in Czech, Slovak and English language and has a communicative knowledge of French.

Ľuboš is an author of various specialized articles particularly from the field of civil procedure and international business law. Cristina
Ionescu

Cristina Ionescu graduated from the Faculty of Law, University of Bucharest and acquired a master degree in Judicial Career. She fluently speaks Romanian and English. Cristina is a lawyer in Bucharest, Romania and a member of the Bucharest Bar since 2016.

During her career, Cristina has been mainly involved in litigation proceedings concerning tort law, civil liability, enforcement procedures and consumer protection issues arising from credit contracts containing alleged abusive clauses.

Cristina’s expertise includes coordinating insolvency procedures on behalf of unsecured creditors, including day-to-day monitoring of developments, drafting complaints and appeals and representation in courts of law; providing clients with legal advice in various litigations related to illegal expropriation during the communist regime and further restitution of property.

Cristina has experience in completion of formalities for registration of companies, transfer of shares, change of core business, change of shareholders, change of headquarters, as well as representation before the Trade Register.

 Outside the office, Cristina enjoys to practice ballroom dance and different other sports including swimming, tennis and horse riding.

Miroslav

Dana
Kačmárová

Dana is a graduate of Charles University in Prague, Faculty of Law, and University of Economics in Prague, Faculty of Business Administration. She is an attorney at law cooperating with the Prague branch office, registered in the Register of Attorneys of the Czech Bar Association. She provides legal services in Czech, Slovak and English language and she has basic communication skills in German.

In her practice, Dana focuses on provision of legal advice especially in corporate and real estate matters, she also has an experience in mergers and acquisitions, and financing. Dana participated in preparation of acquisitions and development projects of leading development groups, including loan financing relating thereto. Her experience in contractual law within civil and commercial relations is a matter of course.

Tomáš
Kubíček

Tomáš Kubíček is a member of Litigation and Dispute Resolution team in Prague-based office of Konečná & Zacha and works also with Real Estate team and Labour and Employment team. He speaks Czech and English.

He graduated from the Faculty of Law, Charles University in Prague and attended several courses at the Leiden Law School, Leiden University in the Netherlands as LLP Erasmus student. Tomáš also completed internship programme organized by the Municipal Court in Prague.

Tomáš specializes in litigation. He also advices on all aspects of real estate law, labour and employment law, personal data protection matters and contractual law. Tomáš participates in pro bono activities of Konečná & Zacha.

Petya Kuzeva graduated from the Law Faculty of the Sofia University. She is a fully-admitted Bulgarian qualified lawyer and she focuses especially on complex litigations involving financial matters, loan agreements, collateral agreements, corporate transactions and regulatory investigations.

Petya deals mostly with civil and commercial disputes, representation in court and assisting clients during judicial procedures for enforcing court decisions. She provides clients with legal advice and full legal service in the fields of banking and finance, insolvency and restructuring, contracts, public procurement, real estate and corporate matters.

Petya also represents clients in administrative proceedings in front of public authorities as well as at administrative courts.

Rossen Lachev graduated from the Law Faculty of the Sofia University. He has also represented clients successfully through appeals in a variety of areas. Lenka

Lenka Macáková graduated from the Law Faculty of University of West Bohemia. She is registered in the Register of Attorneys at Law of the Czech Bar Association and is an associated attorney at law to the Prague-based office. Lenka speaks Czech and English.

In the course of providing legal services Lenka deals predominantly with the disputes and provide clients with legal advisory at the courts, in arbitration proceedings as well as in connection with the insolvency and bankruptcy proceedings.

Lenka has recently been advising several clients on insolvency cases and her experience in this area include also representing of client in the insolvency proceedings of rail wagon producer (with creditors’ claims worth three billion Czech Crown) including representation of the client on the creditors' committee and subsequent litigation, including litigation in front of the Supreme Court of the Czech Republic and in front of the Constitutional Court.

Apart from the aforementioned Lenka also deals with other branches of law related to the business and enterpreneur’s activities, particularly with the corporate law, M&A law as well as intellectual property law.

Andrea

Andrea graduated from Faculty of Law, Charles University in Prague in 2007 where she currently continues her studies in Ph.D. study program. She also spent a year at the Faculty of Law at Queen's University in Great Britain within the Erasmus program.

Andrea has an extensive experience in the areas of banking, finance and capital markets, real estate, corporate law and M&A deals. Andrea has provided legal services to banks and other financial institutions and investors in project, acquisition and real estate financing. Andrea also deals with banking and financial regulation and she has represented clients in various licensing and other administrative proceedings at the Czech National Bank. In the area of ​​capital markets, she focuses mainly on legal aspects of issues of securities, public offering vs. private placement, drafting the prospectus in public offers and legal advisory in relation to provision of investment services.

Andrea is attorney-at-law registered in the Czech Bar Association since 2010 and cooperates with the Prague-based office. Andrea is fluent in English, Czech and Slovak language.

Tomáš Riedl graduated from the Faculty of Law of the Charles University in Prague and attended also study abroad program at TU Dresden - Juristische Fakultät in Germany. Simon
Šufliarsky

Simon Šufliarsky graduated from the Faculty of Law, Comenius University in Bratislava. He is registered as an attorney with the Slovak Bar Association and he is an attorney cooperating with Konečná & Zacha law firm in Bratislava. He speaks Slovak, English and German.

During his practice, Simon focused on acquisition law, real estate law, copyright law in the context of IT, data protection law and medical law. He participated in due diligence, on the preparation of acquisitions and related negotiation in various sectors, in particular with regard to real estate and technology companies. Simon has gained extensive experience in the area of corporate restructuring. He has experience with the process of obtaining licenses to provide investment services for securities dealers and has prepared the framework with regard to AML (Anti-Money Laundering) regulation.

Mikhail Tikhonov graduated from the Faculty of Law, State University of Kemerovo. Mikhail is member of the St. Petersburg Bar and he is cooperating with the St. Petersburg office of Konecna & Zacha. He speaks English and Hebrew. Formerly, he worked with a international law firm and acted as a board of directors’s legal counsel of a world top 10 coalmining company. Hana Ferklová focusses on the area of ICT and the related complex contractual agenda, project finance and IP law. Hana also advises in the area of electronic communications and NW build and maintenance. 

In respect of the latter, Hana advises on regulatory and commercial matters for clients providing services of electronic communications and services of NW build and maintenance, and supports clients in their participation in RFQs and tenders, including the CTO's tenders for radio frequency assignments. In the aforementioned areas of her focus, Hana has advised on number of complex projects of local and international clients.

Simona
Karakaš

Simona is a Romanian qualified lawyer who graduated from the Faculty of Law, University of Bucharest and obtained an LLM degree in International Business Law from the Central European University, Budapest. She has also graduated from TMC Asser Instituut, the Hague. Simona has particular expertise in corporate, M&A and real estate sectors as well as in international finance transactions.

During the first years of her career Simona has worked intensively on cross-border financing transactions by assisting various global banks in relation to syndicated loans and complex security packages. Subsequently she has gained vast experience in the corporate, M&A, real estate and private equity fields. She has assisted major investment funds in real estate M&A transactions, including the acquisition of several large office buildings in Bucharest. She has also advised clients on the acquisition of top players in various industry branches, such as, leasing companies, an international health services provider, a credit bureau, IT and Telecom companies, a paints manufacturer and a regional producer and distributer of water. More recently Simona conducted detailed analytical assessments of a number of commercial and financial legal sectors, with focus on secured transactions and factoring in all EBRD's countries of operations. The goal of these comparative studies was to identify the jurisdictions which would benefit from legal reform in those sectors.

Simona is a Romanian native speaker, fluent in English and Croatian. She also has working knowledge of French. Throughout her career she kept a constant interest and attended numerous courses in the field of life, corporate and executive coaching and is a qualified NLP Practitioner.
