Program Antivirus aimed to help employers and employees approved by the government

The Czech government had on March 23, 2020 approved program introduced by the Ministry of Labor and Social Development called “Antivirus” in order to financially help the employers, who are affected by the restrictions connected with the pandemic of coronavirus causing illness COVID-19, and simultaneously protect employees against the termination of the employment agreement.

Program includes below mentioned regimes from A-E differing in situations in which the employer can submit the applicaation for the contribution before the Czech Labor Office.

Regime A

If the employee is in mandatory quarantine, he/she is entitled for compensatory wage amounting 60 %. The employer is entitled in such a case for the contribution in full amount of the paid compensatory wage.

Regime B

The employer is forced to close the business premises due to the emergency measures declared by the government. The employee is entitled for compensatory wage amounting 100 %. The employer is in this regime entitled for the contribution amounting 80 % of the paid compensatory wage.

Regime C

The employer is unable to allocate work to the employees due to the quarantine of the employees and/or because significant part of the employees take care of their children (according to the press release of the Ministry of Labor and Social Development by “significant part of the employees” is meant 30 % of the employees of the employer, or in business premises, or in another organizational part of the employer). The employee, who is not in the quarantine or is not taking care of his/her children, is entitled for compensatory wage amounting 100 %. The employer is entitled for the contribution amounting 80 % of the paid compensatory wage.

Regime D

Drop in availability of inputs (goods, services, material) necessary for the business operation due to the emergency measures. The employee is entitled for compensatory wage amounting 80 %. The employer is entitled for the contribution amounting 50 % of the paid compensatory wage.

Regime E

Drop in demand for services, goods and other products of the employer due to the quarantine measures in the place of business. The employee is entitled for compensatory wage amounting at least 60 % (according to the internal regulation of the employer or the agreement with the trade union). The employer is entitled for the contribution amounting 50 % of the paid compensatory wage.

The application for the contribution needs to be submitted to the Labor Office of the Czech Republic after the end of every month. The application for the contribution for March should be submitted at the beginning of April, according to the press release of the Ministry of Labor and Social Development.
